New York State Punishing The Producers

Question: Does Graduated Income Taxes at the State Level Violate the Equal Protection Clause of the United States Constitution?

Instead of living within it’s means the State of New York is (yes, you guessed correctly) increasing taxes on the “evil” rich. I don’t know of anyone that was employed by a poor person. Using wealth envy to attack the producers is a really bad idea. To think that this will prevent statewide economic catastrophe is lunacy.

You have to love “graduated” income tax brackets. Karl Marx sure did.

New York wants an increase of from 1.4 to 2.6 percent on anyone making over $250,000.

$250,000 - $499,000 - 8.25 percent
$500,000 - $999,999 - 8.97 percent
$1,000,000 and up - 10.3 percent

Is there anyone in New York state or any other state that has a graduated income tax willing to challenge this on the basis of the Equal Protection Clause of the United States Constitution?

I think there is a valid argument to be made here!

The “Equal Protection Clause is a portion of the Fourteenth Amendment to the U.S. Constitution that prohibits discrimination by state government institutions. The clause grants all people “equal protection of the laws,” which means that the states must apply the law equally and cannot give preference to one person or class of persons over another.

From my understanding this does not apply to the Federal Government but does apply directly to the States.

Graduated income taxes DOES GIVE preference to one person or class of persons over another. The citizens of the United States may not be able to change the way Washington DC does business but, we can surely start putting pressure on the states to end the discriminatory practice of graduated income taxes.

Who has the stones to challenge their state? It would be a worthy challenge.

All of the major news outlets are reporting that the stimulus bill voted out of conference committee last night has a meager $789 billion price tag. This number is pure fantasy. No one believes that the increased funding for programs the left loves like Head Start, Medicaid, COBRA, and the Earned Income Tax Credit is in anyway temporary. No Congress under control of the left will ever cut funding for these programs. So what is the true cost of the stimulus if these spending increases are made permanent?

Total bill for the Generational Theft Act: $3.27 trillion.

President Obama’s attempt to “reach across the aisle” (aka: assure a democrat majority in the united states senate by appointing a republican senator to your cabinet) backfires and his administration gets “BURNED!” Check the photo!


Republican Sen. Judd Gregg abruptly withdrew his nomination as President Barack Obama’s commerce secretary Thursday, telling Politico that he “couldn’t be Judd Gregg” and serve in the Cabinet.

In a separate statement, Gregg cited his problems with the economic stimulus bill, as well as partisan disagreements over how to run the Census as reasons for pulling his nomination.

Stimulus Plan Limits Seniors Health Care

Betsy McCaughey in a Bloomberg commentary, Ruin Your Health With the Obama Stimulus Plan, According to McCaughey;

One new bureaucracy, the National Coordinator of Health Information Technology, will monitor treatments to make sure your doctor is doing what the federal government deems appropriate and cost effective. The goal is to reduce costs and “guide” your doctor’s decisions

Quoting the disgraced tax evader, Tom Daschle,  McCaughey writes;

According to Daschle, doctors have to give up autonomy and “learn to operate less like solo practitioners.”

Elderly Hardest Hit

Daschle says health-care reform “will not be pain free.” Seniors should be more accepting of the conditions that come with age instead of treating them. That means the elderly will bear the brunt.

Medicare now pays for treatments deemed safe and effective. The stimulus bill would change that and apply a cost- effectiveness standard set by the Federal Council (464).

The Federal Council is modeled after a U.K. board discussed in Daschle’s book. This board approves or rejects treatments using a formula that divides the cost of the treatment by the number of years the patient is likely to benefit. Treatments for younger patients are more often approved than treatments for diseases that affect the elderly, such as osteoporosis.

In 2006, a U.K. health board decreed that elderly patients with macular degeneration had to wait until they went blind in one eye before they could get a costly new drug to save the other eye. It took almost three years of public protests before the board reversed its decision.

Bottom line, Seniors will be sent home to die.

800 Billion Dollar Stimulus - No Sale!

One of the oldest tricks in a salesman’s book is telling his customer they have to act and they have to act NOW.  It’s a limited offer, a 1 day sales event, the price is about to go up, it will never be offered again at this price. You get the picture.

Here comes President Obama selling the United States citizens his democratic party dream of a century everything they ever wanted to have guaranteed power forever Stimulus bill. Not only is President Obama saying act now but he is adding the element of fear by saying that disaster will befall us if we don’t act. Really Mr. President!  Still talking doom a gloom? Next thing you know you will be telling the American people they are in a Malaise!

Believe me when I tell you this. The Democrats will destroy the economy of The United States if it helps achieve their political goals.  They already demonstrated that with forced subprime loans, Freddie Mac, Fannie Mae and talking down the economy on the run-up to the election.

The Democrats are going to spend 800 Billion dollars on things that have NO promise of stimulating the economy.  This will indebt every man, woman and child in America with a payment of 2,580 dollars or more, plus interest.  I don’t see how The United States government will be able to service the debt load that they are accumulating now. We would be better off if they do nothing.

Are we supposed to believe that the Government can better spend the money than the people they are supposed to represent? What the people need is tax relief.  I still say that a 3 month tax holiday would be the best stimulus package available and it would NOT cost more than 350 billion dollars. It’s a no brainer!  Watch how fast the “producers” can turn the economy around!
Now it look like this “NON stimulus” plan is going to pass thanks to some Republican turncoats in The United States Senate.

Majority Leader Harry Reid (D., Nev.) credited Specter and Sens. Susan Collins (R., Maine), Ben Nelson (D., Neb.) and Joe Lieberman (I., Conn.) with saving the package. 1

Arlen Specter, “aka Democrat light” of Pennsylvania said, “But I do believe we have to act, and under the circumstances, this is the best we can do.”  He thought that it was a “very unpopular vote.”1 Parts of the bill “give me heartburn,” Specter said.1  Senator Specter, if this is the best you can do perhaps the people of Pennsylvania will exercise your retirement plan 21 months from now. Bet on it!

Lieberman, in a news conference, said Specter and Collins “really deserve the medal of honor for what they’ve done here tonight. They’ve put national interest ahead of party interest.1 Hey Joe, it’s more like a badge of dishonor and putting self interest first.
 
This Stimulus bill is wrong on all counts and need to be stopped now.

The Communist Manifesto

President Woodrow Wilson, the first President of The United States to use the D word, Democracy. Also Lurched America to the left under the guise of “Progressive reform.”

Central Banking and a graduated, progressive Income Tax became law during his administration.

I’m posting this here as a reminder to all Americans just how far along our country has moved toward the 10 planks of the Communist Manifesto. I present the list from Karl Marx and Frederick Engels original document, (translated of course), with a few remarks of my own.

1. Abolition of property in land and application of all rents of land to public purposes.

2. A heavy progressive or graduated income tax.

The 16th amendment of the United States Constitution, ratified in 1913, established a tax on income. Originally it was 1% on the first $20,000 and 7% on incomes above $500,000. In the beginning less than 1% paid income tax.

Progressive and graduated, Washington DC has turned this into a heavy burden on the American economy.  The producers are punished and the non-producers are rewarded with welfare payments cleverly called “refundable tax credits” or “unearned income tax credits.”

3. Abolition of all rights of inheritance.


When the Bush tax cuts expire in 2011 the State confiscates as much as 55% of estates upon the owner’s death. That is more than half the way towards abolishment of inheritance, right there.

4. Confiscation of the property of all emigrants and rebels.

5. Centralization of credit in the banks of the state, by means of a national bank with state capital and an exclusive monopoly.

Can you say Federal Reserve? I’ll bet you can.

Is the Democrat triumvirate of Obama, Pelosi and Reid going to bring about the nationalization of our banking institutions.  I sure wouldn’t put it past them.

Do you remember what President Obama’s Chief of Staff,  Raul Emmanuel said? “You never want a serious crisis to go to waste.”

Economic conditions being what they are, this bears watching very closely.

6. Centralization of the means of communication and transport in the hands of the state.

7. Extension of factories and instruments of production owned by the state; the bringing into cultivation of waste lands, and the improvement of the soil generally in accordance with a common plan.

8. Equal obligation of all to work. Establishment of industrial armies, especially for agriculture.

9. Combination of agriculture with manufacturing industries; gradual abolition of all the distinction between town and country by a more equable distribution of the populace over the country.

10. Free education for all children in public schools. Abolition of children’s factory labor in its present form. Combination of education with industrial production, etc.

Free education in Government schools.  Sound familiar?
 
Placing your child in a Government school is the worse form of abuse a parent can carry out.

Doom and Gloom!

With a population of 303,824,640 people the United States citizens will be completely unemployed in a few weeks. That is, if Nancy Pelosi has her facts right.

Maybe she misspoke and really meant that 500 million Americans will lose their jobs in 1 month. I guess she must be counting all 303 million Americans and another 197 million illegal aliens.

Looks like the aged, hollow eyed, hippie chick’s mind has turned on, tuned in and dropped out.

The real scary part! She is the most powerful woman in the world and 2nd in line to the Presidency of the United States.

ALBANY - Gov. Paterson, defying the liberal wing of his Democratic Party, has chosen little-known, NRA-backed, upstate Congresswoman Kirsten Gillibrand to succeed Hillary Rodham Clinton as New York’s junior senator, it was learned last night.

The surprising - and, for many Democrats shocking - decision to pick the conservative Gillibrand, 42, from Hudson in Columbia County, was disclosed by the governor in calls to party officials and some members of the state’s congressional delegation, many of whom said they were unhappy with the selection, sources said.
